1. Service provider identification

2. Nature of the service

COSTAKEY is a real estate agency and vacation rental management company based in Guardamar del Segura (Alicante). Through costakey.life we offer tourist accommodation and booking management in our own name for properties under our management or mandate.

This portal is not a marketplace: we do not connect independent buyers and sellers or split payments to third parties. The accommodation contract and price are with COSTAKEY as provider and merchant of record.

3. Capacity and registration

You must be at least 18 years old and have legal capacity to contract. Registration information must be accurate and kept up to date.

You are responsible for keeping your credentials confidential. Notify us immediately of any unauthorised use at info@costakey.life.

COSTAKEY may refuse or cancel registrations that breach the law, public order or these Terms.

4. Internal access (not a marketplace)

Private areas support agency operations. Third parties do not sell on their own behalf through a marketplace:

• Client (guest): browses COSTAKEY’s catalogue, books and pays COSTAKEY.
• Associated owner: titleholder who granted COSTAKEY a management mandate; access is for portfolio visibility, not to collect bookings in their own name.
• Agent: authorised COSTAKEY employee or contractor.
• Administrator: COSTAKEY staff (support, portfolio, compliance).

5. Catalogue and content

Published properties are part of COSTAKEY’s managed catalogue. COSTAKEY is responsible for information shown to guests and for licences, insurance and authorisations required by law.

COSTAKEY may remove or update inaccurate, illegal or unsafe listings.

6. Booking process

The booking is between the guest and COSTAKEY when dates and price are confirmed on the site and payment is completed (or another method indicated by the agency).

Check-out date must be strictly after check-in date. The system validates this automatically.

The total price is for COSTAKEY’s accommodation service, with the stated breakdown. Local tourist taxes will be disclosed where required.

7. Payments (COSTAKEY as merchant; Stripe as processor)

Card payments use Stripe Checkout on COSTAKEY’s standard Stripe account (we do not use Stripe Connect or split funds to third-party sellers). Your bank statement will show a charge to COSTAKEY or our configured descriptor.

Stripe is only a payment service provider; the accommodation contract is with COSTAKEY. By paying, you accept Stripe’s applicable terms.

COSTAKEY does not store full card numbers. Refunds are handled by COSTAKEY per our Refund Policy and consumer law (RDL 1/2007, B2C).

8. Cancellations and changes

Full cancellation and refund rules are in our Refund & Cancellation Policy. The applicable tier (flexible, moderate, strict) is shown before you confirm.

Date change requests are subject to availability and confirmation by COSTAKEY.

9. Guest obligations

Use the property diligently, respect community rules, maximum occupancy and prohibitions on parties or unlawful activity. You are liable for damage caused by negligence or misuse.

10. Prohibited use

You may not: impersonate others, scrape or automate unauthorised access, introduce malware, publish unlawful content, operate a third-party marketplace via this site, divert COSTAKEY booking payments to other accounts, or use the site unlawfully.

11. Stripe policy compliance

COSTAKEY represents to Stripe and guests that it does not operate a marketplace or facilitate payments between buyers and independent sellers. Charges are for accommodation services provided by COSTAKEY. Using this site to collect on behalf of unauthorised third parties or for Stripe-restricted activities is prohibited.

12. Intellectual property

Software, design, the COSTAKEY brand and editorial content belong to COSTAKEY or its licensors. Reproduction without permission is prohibited.

Contributors of photos or text retain their rights and grant COSTAKEY a non-exclusive licence for portfolio promotion and management.

13. Limitation of liability

COSTAKEY does not guarantee uninterrupted availability (including Stripe outages). As accommodation provider, COSTAKEY is liable to guests under law and contract, without prejudice to mandatory consumer rights.

Where permitted by law, additional economic liability is limited to the amount paid for the affected booking, except for fraud or gross negligence.

14. Force majeure

Neither party is liable for failure due to causes beyond reasonable control (natural disasters, authority-declared pandemics, war, widespread utility or internet outages).

15. Amendments and governing law

We may amend these Terms by publishing a new version on costakey.life. Continued use after publication implies acceptance, subject to non-waivable consumer rights.

Spanish law applies. For disputes with EU resident consumers, courts at the consumer’s domicile or Alicante apply as per applicable rules. Business users (B2B) submit to the courts of Alicante.
